Kalshi is legal at the federal level: it has been a CFTC-regulated exchange since 2020. But as of October 17, 2026, court orders block its sports contracts in Nevada, Washington and Michigan, and about 14 more states are fighting it in court.
Yes, Kalshi is legal in the US at the federal level. It has been a CFTC-regulated exchange since November 2020, and the CFTC is defending it in court. But as of October 17, 2026, court orders force Kalshi to block sports contracts in Nevada, Washington and Michigan, and about 14 more states are challenging it. Below is where Kalshi stands in every state, with sources.
Yes. The CFTC designated KalshiEX LLC a contract market in November 2020. Kalshi’s help centre puts it plainly: “Kalshi is regulated by the Commodity Futures Trading Commission (CFTC), an independent agency of the US government.” In September 2024 Kalshi won its election-contracts case against the CFTC in federal district court in Washington, DC, and the CFTC dropped its appeal in May 2025 (reported by Covers).
In 2026 the CFTC switched from opponent to ally:
The dispute is over sports contracts. Kalshi argues federal commodities law pre-empts state gambling law. States argue sports event contracts are sports betting. Federal appeals courts have split:
New Jersey has asked the Supreme Court to resolve the split (docket 26-299). Kalshi’s response is due November 9, 2026. Ohio and 38 other states plus DC filed a brief urging the Court to take the case.

“Contested” means a state has taken action but Kalshi hasn’t been ordered to geofence. Kalshi doesn’t publish a state list, so confirm in the app, which checks your location.
Most state actions target sports only. The exceptions: Nevada’s order also covers election and entertainment contracts, Washington’s covers politics, culture and more, New York’s lawsuit targets the whole platform, and Minnesota’s (now blocked) law covered all prediction markets, including weather. We found no state action aimed at Kalshi’s economics, finance or weather markets beyond Minnesota’s law. Those are available everywhere Kalshi operates.
Kalshi’s sign-up page says you must “be 18 years or older” and pass identity verification. Its member agreement, as quoted in Missouri’s letter, requires the age of majority in your state. Several states, including New York, Missouri and Connecticut, specifically object to 18-to-20-year-olds trading sports contracts.
Yes, federally. KalshiEX LLC has been a CFTC-designated contract market since November 2020, and the CFTC backs its right to list event contracts nationwide. Whether states can stop its sports contracts is unsettled: federal appeals courts have split, and New Jersey has asked the Supreme Court to decide.
As of October 17, 2026, court orders require Kalshi to block sports contracts in Nevada, Washington and Michigan. In Nevada the ban also covers election and entertainment contracts, and in Washington politics, entertainment and several other categories. Kalshi's economics and financial markets remain available in all three.
State actions so far have targeted Kalshi, not its users. Courts and regulators have ordered the company to geofence, pay penalties or stop offering contracts. Private class actions in a few states seek to recover losses from Kalshi. Check the rules in your state, and use only what the app lets you trade where you are.
18, per Kalshi's sign-up help page, and of the age of majority in your state, per its member agreement. Several states, including New York, Missouri and Connecticut, have objected to 18-to-20-year-olds trading sports contracts.
