Yes, prediction markets are available throughout California. As of October 17, 2026 we found no enforcement action by California’s Attorney General or regulators against Kalshi, Polymarket US, Novig, PredictIt or others. The legal issue to watch is narrower: tribal land.
California’s position
California has no legal sports betting. The Legislative Analyst noted that “state law currently bans sports betting in California,” and voters rejected Proposition 27, which would have allowed online sports betting, in 2022. The state hasn’t moved against prediction markets directly. Attorney General Rob Bonta did sign the October 2026 multistate brief urging the Supreme Court to side with New Jersey against Kalshi.
The tribal-lands case
California tribes, led by the Blue Lake Rancheria, sued Kalshi under the federal Indian Gaming Regulatory Act. On September 16, 2026, the Ninth Circuit held that the tribes are likely to succeed in claiming that Kalshi’s sports contracts entered from tribal lands violate the Act. It sent the case back to the district court to decide whether to issue an injunction. The court received the Ninth Circuit’s mandate on October 8 and set a status conference for October 21, 2026.
