Are prediction markets legal in Nevada?

Nevada is the most restrictive state for prediction markets. State court orders have pushed Kalshi to geofence its sports, election and entertainment markets and blocked Polymarket US entirely, and the Ninth Circuit sided with Nevada in August 2026. Novig and Polymarket US are unavailable.

Mostly no. As of October 17, 2026, Nevada is the hardest state in the US for prediction markets. Court orders have made Kalshi geofence its sports, election and entertainment markets and blocked Polymarket US altogether, and Novig doesn’t operate here. The Ninth Circuit backed Nevada in August 2026.

Nevada’s position

The Nevada Gaming Control Board, regulator of the state’s casino industry, has acted against nearly every major platform since early 2025:

• Kalshi: cease-and-desist (March 4, 2025). After a federal injunction protecting Kalshi was dissolved in November 2025, a state court entered a preliminary injunction on May 18, 2026 barring “contracts on sports-, election-, or entertainment-related events.” In July Kalshi agreed to a “multi-source geofencing solution” by August 12, 2026, or pay “$120,000 per day.”
• Polymarket US: a state lawsuit (January 16, 2026), a restraining order (January 29) and an injunction (May 29, 2026). Polymarket US is unavailable in Nevada.
• Robinhood and Crypto.com: both agreed to limit their event-contract offerings in Nevada after losing injunction bids in late 2025.
• Coinbase: restraining order (February 2026) and preliminary injunction (March 2026).

The Ninth Circuit ruling

On August 28, 2026 the Ninth Circuit ruled 3–0 for Nevada in the Kalshi, Robinhood and Crypto.com cases. In Kalshi’s case it held that federal law “likely does not preempt Nevada’s gaming regulations as applied to Kalshi’s sports event contracts,” and sent the election-contract question back to the lower court. Kalshi has asked the full Ninth Circuit to rehear the case, and Crypto.com has petitioned the Supreme Court. See is Kalshi legal?

Sportsbook brands

In November 2025 the Board accepted the surrender of FanDuel parent Flutter’s Nevada licences, and the withdrawal of DraftKings’ pending applications, stating both “intend to engage in unlawful activities related to sports event contracts.”
