North Dakota has no commercial or mobile sports betting. Lawmakers rejected a 2025 constitutional amendment to allow it (HCR 3002, defeated 24–70 in the House on January 22, 2025), and per Tribal Gaming & Hospitality the state’s tribes are “the only lawful providers of sports wagering in the state,” in person at their casinos.
North Dakota is one of the few states that has stayed out of the fight: it didn’t sign the April 2026 attorneys general letter to the CFTC or the October 2026 states’ brief at the US Supreme Court. See is Kalshi legal?
With no commercial sportsbooks, North Dakota gets the sports products too: DraftKings lists it among its Predictions states, and FanDuel lists it in its Predicts offer terms. Kalshi, Polymarket US, Novig, PredictIt and Robinhood are also available. Compare every state in our legality tracker.
Kalshi is available in North Dakota. We found no North Dakota Attorney General or regulator action against Kalshi, Polymarket US, Novig or PredictIt as of October 18, 2026.
Not commercially. A 2025 resolution (HCR 3002) to amend the constitution to allow sports betting failed in the House 24–70 on January 22, 2025. Tribal casinos are the only lawful in-person providers, per Tribal Gaming & Hospitality.
No. North Dakota isn't among the 38 states plus DC that signed the October 2026 amicus brief in Flaherty v. KalshiEX, and it wasn't on the April 2026 attorneys general comment letter to the CFTC either.
