Utah bans all gambling, and in August 2026 a federal court ruled that federal law doesn't stop Utah enforcing that ban against Kalshi. Kalshi has appealed, but the Tenth Circuit refused to block Utah in the meantime. We found no action against other platforms.

Prediction markets are legally exposed in Utah, the one state where a court has issued a final judgment against Kalshi. As of October 17, 2026, Utah has won the right to enforce its gambling ban against Kalshi, and Kalshi’s appeal is pending. We found no Utah action against Polymarket US, Novig, PredictIt or others, but the same law would apply to them.
Utah’s constitution prohibits gambling, and the state has no legal sports betting. Attorney General Derek Brown: “Utah’s constitution bans gambling to protect Utah families, and my office will enforce that ban.” Under Utah law, as cited by the federal court, anyone who “intentionally provides or offers to provide a form of online gambling” to someone in Utah commits a third-degree felony.
Kalshi sued Utah in February 2026, seeking to block enforcement. On August 4, 2026, Judge Robert J. Shelby ruled for Utah: “The court concludes the CEA does not preempt Utah’s enforcement of its anti-gambling laws against Kalshi.” Kalshi appealed to the Tenth Circuit, which on September 8, 2026 denied it an injunction while the appeal proceeds. The CFTC filed a brief supporting Kalshi in late September. On October 14 the district court dismissed Kalshi’s own request for interim relief as moot. We found no Utah enforcement filed yet, and couldn’t confirm whether Kalshi has geofenced Utah. See is Kalshi legal?
We found no Utah action against Polymarket US, Novig, PredictIt or Robinhood. DraftKings Predictions and FanDuel Predicts both list Utah as a state where they offer sports contracts. Given the Kalshi ruling, all of these face the same legal risk in Utah. For every state side by side, see our legality tracker.
It's contested and at real risk. On August 4, 2026 a federal judge ruled that 'the CEA does not preempt Utah's enforcement of its anti-gambling laws against Kalshi.' The Tenth Circuit refused to block Utah while Kalshi appeals. We found no Utah enforcement filed yet and couldn't confirm whether Kalshi has restricted Utah.
No. Utah's constitution bans gambling, and its Attorney General says 'my office will enforce that ban.' Offering online gambling to people in Utah is a third-degree felony under state law, as cited by the federal court.
Both list Utah among the states where they offer sports contracts, since Utah has no sportsbooks. The Utah ruling against Kalshi suggests these products face the same legal risk there.
